1. Acceptance of Terms

By downloading, installing, or using the ScanOrderPay mobile application or web platform (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

ScanOrderPay is operated by ScanOrderPay ("we," "our," or "us"), based in Athens, Greece. These Terms are governed by the laws of the Hellenic Republic and the European Union.

2. Eligibility

  • You must be at least 16 years old to create an account
  • Users under 18 may use the Service with parental or guardian consent
  • You must provide accurate, current, and complete information
  • You are responsible for maintaining the confidentiality of your account

3. Service Description

ScanOrderPay provides a digital ordering platform that enables:

  • QR Code Ordering: Scan a QR code at a restaurant table to browse menus and place orders
  • Express Pickup: Order ahead and skip the line at participating venues
  • AI Assistant: Sofia AI helps with menu recommendations and dietary information
  • Digital Payments: Pay via credit/debit card, Apple Pay, Google Pay, or cash
  • GPS Delivery: Location-based delivery for outdoor venues
  • VIP Subscriptions: Premium features including priority queue and discounts

4. Orders and Payments

4.1 Placing Orders

  • Orders are placed directly with the participating restaurant
  • ScanOrderPay acts as a technology platform facilitating the transaction
  • Menu items, prices, and availability are set by each restaurant
  • Once submitted, orders may not be cancellable depending on preparation status

4.2 Payment Processing

  • Payments are processed securely via Stripe (PCI-DSS compliant)
  • Apple Pay and Google Pay are available where supported
  • Cash payments are handled directly by the restaurant
  • All prices are displayed in Euros (EUR) unless otherwise specified
  • Tips are optional and go directly to restaurant staff

4.3 Refunds

  • Refund policies are determined by each restaurant
  • Contact the restaurant directly for order-related refunds
  • ScanOrderPay subscription refunds follow Apple/Google refund policies

5. In-App Purchases and Subscriptions

  • Express VIP: Auto-renewable subscription at EUR 29.99/year
  • VIP benefits include priority queue, 5% order discounts, and a VIP badge
  • Subscriptions are billed through your Apple ID or Google Play account
  • Auto-renewal may be turned off in your device settings at least 24 hours before the end of the current period
  • No cancellation of the current subscription is allowed during the active period
  • Any unused portion of a free trial period is forfeited upon purchase

6. User Conduct

You agree NOT to:

  • Use the Service for any unlawful purpose
  • Place fraudulent orders or use stolen payment methods
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of the Service
  • Impersonate another person or entity
  • Upload malicious content or attempt to exploit vulnerabilities
  • Use the Service to harass restaurant staff or other users

7. Intellectual Property

All content, features, and functionality of the Service (including but not limited to text, graphics, logos, icons, images, and software) are owned by ScanOrderPay and are protected by international copyright, trademark, and other intellectual property laws.

Restaurant menus, logos, and images are the property of their respective owners and are displayed with their permission.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

We are not responsible for the quality, safety, or legality of food items ordered through the platform. Restaurants are solely responsible for food preparation and safety compliance.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCANORDERPAY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO FOOD ALLERGIES, DELIVERY DELAYS, OR PAYMENT DISPUTES.

11. Governing Law

These Terms are governed by the laws of Greece and the European Union. Any disputes arising from these Terms shall be resolved in the courts of Athens, Greece.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason. You may delete your account at any time through the app settings or by contacting support.

Apple-Specific Terms

  • Apple is not a party to this agreement and has no obligation to provide maintenance or support
  • In-app purchase refunds are handled through Apple's standard refund process
  • Apple has no responsibility for addressing user claims related to the app
  • Apple is a third-party beneficiary of this agreement
